Interpretation and Definitions

 

Interpretation 

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

 

Definitions

For the purposes of this Return and Refund Policy: 

●    “Company” (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to Cell Phone Seat LLC.

●    “Goods” refers to the items offered for sale on the Service.

●    “Orders” means a request by You to purchase Goods from Us.

●    “Service” refers to the Website.

●    “Website” refers to www.cellphoneseat.com or other related websites owned by Company.

●    “You” means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

 

The following terms are applicable for any Goods that You purchased with Us.

 

Your Order Cancellation Rights

You are entitled to cancel Your Order within 1 day of placing Your Order without giving any reason for doing so. If your Order has NOT shipped then you will be refunded in full. If your Order HAS already shipped, you will be responsible for returning your order within 10 days of delivery and will receive the amount you paid for your order minus shipping fees and minus a $5 restocking fee. 

 

Your Return Rights

The deadline for returning Goods is 10 days from the date on which You received the Goods or on which a third party you have appointed, who is not the carrier, takes possession of the Goods delivered. 

In order to exercise Your right of return, You must inform Us of your return decision by means of a clear statement within 10 days of receiving Your Goods. You can inform us of your return decision by visiting this page on our website: https://www.cellphoneseat.com/pages/contact, and filling out the form stating Your decision to return. Please include Your Order number when informing Us about Your decision to return Your Goods. 

We will NOT reimburse return requests if you inform Us of Your return MORE THAN 10 DAYS from the date on which the Goods were delivered to You or a third party. We feel that 10 days is enough time to review and test the Goods and make a decision to return them. 

We will NOT reimburse You for Goods received past 10 days from the date on which You received the Goods or on which a third party you have appointed, who is not the carrier, takes possession of the Goods delivered. The only exception to this policy is if You have informed Us of Your return decision within 10 days from the date on which You received the Goods or on which a third party you have appointed, who is not the carrier, takes possession of the Goods delivered. 

If the Goods are returned within the 10 day return period, We will reimburse You no later than 30 days from the day on which We receive the returned Goods. We will attempt to use the same means of payment as You used for the Order, minus a $5 return fee.

We will NOT reimburse You for shipping fees, neither the cost of shipping the Goods to You or the cost of returning the Goods to Us, under any scenario. 

 

Affiliate Plans, Sales, and Discount Codes

Goods purchased using a discount code, coupon or discount link are not eligible for return under any circumstances. This is because affiliates have been paid a percentage of the sale and that amount is not recoverable by Cell Phone Seat LLC.

 

Conditions for Returns

In order for the Goods to be eligible for a return, please make sure that: 

●    The Goods were received in the last 10 days;

●    The Goods are in the original packaging and the packaging is undamaged;

●    The Goods were NOT purchased at a discount using an affiliate code, coupon code or affiliate link;

●    The following Goods cannot be returned: Goods that were personalized by Us with printing or engraving, or Goods which according to their nature are not suitable to be returned, including damaged or used goods.

We reserve the right to refuse refunds of any Goods that do not meet the above return conditions in Our sole discretion. 

Refunds will NOT be given if the above conditions are not met. Do NOT send Goods to Us unless the above conditions are met. Goods received that do NOT meet the above conditions will NOT be refunded OR returned. 

 

Returning Goods

If the Goods are eligible for returning for a refund based on the Conditions for Returns above, You are responsible for the cost and risk of returning the Goods to Us. You should send the Goods at the following address:

We cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service. We are unable to issue a refund without actual receipt of the Goods or proof of received return delivery.
